APFL Partners contributes to EuroCham Dialogue on regulatory reforms for foreign-invested businesses in Vietnam

On the occasion of the EuroCham Whitebook Dialogue Week 2026 in Hanoi, APFL Partners was honoured to participate in a constructive discussion with the Ministry of Industry and Trade regarding several important regulatory developments affecting foreign-invested businesses in Vietnam.
During the discussions, Antoine Logeay, Partner at APFL Partners, and Long Tran, Of Counsel, had the opportunity to share comments on the draft decree intended to replace Decree 09/2018/ND-CP, which governs the trading and commercial activities of foreign-invested enterprises in Vietnam.
This topic remains particularly important for many international consumer brands and commercial operators active in Vietnam, especially in light of the commitments under the EU-Vietnam Free Trade Agreement (EVFTA) and the removal, since 2025, of the Economic Needs Test (ENT) for EU investors.
It was encouraging to see the openness of the Ministry of Industry and Trade and its willingness to engage with the business community on practical implementation issues and remaining regulatory challenges.
Constructive dialogue between public authorities and the private sector remains essential to improving legal certainty, facilitating investment, and supporting Vietnam’s continued economic integration.
